Terms of Use software services

ClaimsAgent B.V., with office at Rotterdam and registered with the Dutch Chamber of Commerce under nr. 24421586 (hereinafter “ClaimsAgent”), provides this software service (hereinafter the “Service”) through several current Internet browsers (Windows Internet Explorer 7 and up, Modzilla Firefox 3.6 and up, Google Chrome 11 and up Apple Safari 5 and up). You are responsible for installing an Internet browser, anti-virus software and other software to protect your computer system against threats.

The Service is provided ‘as is’ and ‘as available’ and can be altered by ClaimsAgent at its discretion from time to time. ClaimsAgent has no obligation to maintain or add specific properties to the Service. ClaimsAgent does not provide additional services, unless by separate agreement.

All proprietary rights and intellectual property rights to (the contents of) the Service and related websites are vested in ClaimsAgent or in its suppliers and third party content providers. You acknowledge and agree to respect these proprietary rights and intellectual property rights, including the data base rights of the producer of the data base and including all information that is based thereupon and/or derived therefrom. You grant, to the extent necessary, permission to ClaimsAgent to (procure the producer of the data base to) record the data and information provided by you in the data base and to use such data and information to carry out its agreements with its users and other services under the privacy policy stated below.

You agree and undertake to treat confidentially the logon-codes provided to you when registering a user account for the use of the Service and to take all reasonable measures to protect the confidentiality of the logon-codes if and when engaging external assistance or other third parties. You agree and undertake to amend any changes in the data submitted by you forthwith in your user account.

You agree and undertake to procure that you registered e-mail address is active and throughout the use of the Service and to regularly view your e-mail. If and when your e-mail address changes, you must register your new e-mail address in your account forthwith.

By accepting these terms of use and privacy policy, you agree and consent that any and all correspondence and other messages with respect to the claims you have submitted, and all related convocations can be sent to your registered e-mail address.

You may consult and use (the contents of) the Service and related websites, including the transfer and exchange of data, only for your personal use and at your own risk. You are not allowed to disclose, reproduce or commercially exploit the information obtained from the Service and related websites of ClaimsAgent and all information that is based thereupon and/or derived therefrom on a non-incidental basis, in whatever form, including, whether or not after processing, to integrate this information in networks or to otherwise disclose this information.

ClaimsAgent nor its suppliers can guarantee the correctness of the data and information that has been transferred, obtained, viewed or used in any way through the Service and related websites of ClaimsAgent. ClaimsAgent and its suppliers exclude direct or indirect liability for any and all damages, including non-pecuniary damages, loss of profit or damages as a result of stagnation, occurring as a result of the use of the Service or any data and information that has been transferred, obtained, viewed or used in any way through the Service and related websites of ClaimsAgent. ClaimsAgent and its suppliers exclude direct or indirect liability for damages as a result if interruption in or unavailability of the Service and related websites.
 
When you use the Service you must comply with instructions that ClaimsAgent may provide.

You must refrain from the following activities:

  • submitting claims for verification that are non-existent or for an increased amount (punishable under section 344 Dutch Criminal Code);
  • use of the internet services and websites in a manner that can violate the rights of ClaimsAgent or its suppliers, its customers or to third parties;
  • sending unwanted messages of a commercial nature (spam) to persons whose e-mail address you have obtained through the internet services and websites of ClaimsAgent;
  • altering, damaging, disconnecting, overloading, hindering or obstructing the use of the Service and related websites of ClaimsAgent;
  • distribution of viruses or other files that contain harmful components.


The use of the Service of ClaimsAgent is governed by the laws of The Netherlands. Any claim or dispute which may arise out of or in connection with the use of the Service shall in first instance be settled by the District Court of The Hague, the Netherlands.

Privacy Policy

Introduction

ClaimsAgent deems protecting the privacy of its customers and the visitors to its websites essential to its activities. Therefore, personal data of customers and visitors are treated and secured with care. In accordance with the Personal Data Protection Act, the processing operation has been reported to the Supervisor, the Dutch Data Protection Authority in The Hague, the Netherlands. ClaimsAgent will at all times observe the requirements set by the Dutch Personal Data Protection Act.

Processing of Personal Data

ClaimsAgent will record personal data of customers and visitors to its internet services and websites. ClaimsAgent will use such data for the performance of the relevant agreement, for its other services or to keep customers informed of (new) products and services of ClaimsAgent.
If you do not wish to receive any information on (new) products or services, please notify ClaimsAgent in writing, for the attention of the Address Registration Department, Jan van Ghestellaan 31, 3054 CE Rotterdam, or by email to info@ClaimsAgent.nl, so that ClaimsAgent can block your data for the above-mentioned purposes.
 
User Navigation

ClaimsAgent's internet services and websites keep records, without identifying the visitors, of general visiting data, for the purpose of optimising the layout of the websites. Furthermore, these data may be used to post more specific information on the site, so as to enable ClaimsAgent to further optimise its services to you. These data will be collected on an aggregate basis and will not be provided to third parties for commercial activities.

Cookies are small packets of information (files) that a website leaves behind on your computer. The website instructs the web browser with which you view websites (for example Internet Explorer) to store these cookies on your computer.

Why Does ClaimsAgent Use Cookies?

ClaimsAgent uses only functional cookies to facilitate navigation on the website, in order to analyse the use of the website and to optimise the usability of the website through this analysis.
 
When Does ClaimsAgent Use Cookies?

All websites use cookies with certain technical and site-specific information. If you are logged on to ClaimsAgent, your user name and password may be retained in a cookie.

How Can You Refuse Cookies?

You always have the right to refuse cookies. You can set your web browser to refuse all cookies or only certain cookies (please consult the manual of your web browser on how to do this). If you refuse cookies, certain services may not be available to you.

ClaimsAgent and Other Websites

ClaimsAgent's sites contain several hyperlinks to other websites. However, ClaimsAgent cannot assume responsibility for the treatment of your data by the parties running those websites. ClaimsAgent therefore advises you to read the privacy statement .
     
Amendments

ClaimsAgent reserves the right to make amendments to the abovementioned terms of use and privacy statement without giving notice. The later version of these terms of use and privacy statement supersedes all earlier versions thereof. Please check this privacy statement regularly.
